1. Acceptance of these terms
These Terms of Service govern your access to and use of Echo Effect, including our website, user dashboard, document workflows, payment features, notifications, and any related services we make available to you.
By creating an account, purchasing a package, activating vault storage, or using any part of the platform, you agree to be bound by these terms and by any additional policies referenced in them, including our Privacy Policy. If you do not agree, you must not use the service.
2. Service scope and no legal advice
Echo Effect is a Canada-wide estate planning platform designed to help users organize information, prepare guided legal document drafts, store family records, track account details, and manage supporting planning materials in one secure workspace.
Echo Effect is not a law firm and does not provide legal representation, legal opinions, or legal advice. Any templates, prompts, educational content, AI-assisted guidance, or workflow suggestions are provided for general informational and organizational purposes only.
You remain solely responsible for deciding whether any document, clause, workflow, or package combination is appropriate for your circumstances and for obtaining advice from a qualified lawyer or other licensed professional where needed. You are also responsible for ensuring your documents are executed, witnessed, notarized, stored, and shared in a manner that satisfies applicable law and your own planning objectives.
3. Eligibility and account registration
You may use Echo Effect only if you are legally capable of entering into a binding agreement and are using the service for lawful purposes. If you register on behalf of another person or organization, you represent that you have authority to do so.
You must provide accurate, current, and complete information when creating and maintaining your account. You are responsible for safeguarding your password, passcodes, devices, and any account recovery links sent to your email address.

4. Packages, pricing, and payments
Certain document types, premium features, and account capabilities require paid packages or monthly vault storage. Package availability, pricing, billing intervals, bundle discounts, promo-code rules, and feature access may change over time. Where applicable, charges are processed through third-party payment providers such as Stripe.
You authorize us and our payment processors to charge the payment method you provide for package purchases, vault renewals, taxes, and any other applicable fees. You are responsible for reviewing package details, quantities, and discount terms before purchase and for keeping billing information current.
Except where required by law or expressly stated otherwise, fees are non-refundable once charged. We may suspend or limit paid features if payment fails, vault billing expires, a package entitlement is exhausted, or a charge is reversed or disputed.
5. Acceptable use
You may use the service only in compliance with these terms and applicable law. You must not misuse the platform, attempt to interfere with its operation, or use it in a way that harms us, other users, or third parties.

6. Your content and document responsibilities
You retain ownership of the information, records, uploads, and document content you submit to Echo Effect. By using the service, you grant us the limited rights necessary to host, store, back up, process, display, and transmit that content solely for the purpose of operating, securing, improving, and supporting the platform.
You are solely responsible for the completeness, accuracy, legality, and appropriateness of any account data, family information, financial records, uploaded documents, or instructions you store on the platform. We do not verify factual accuracy and we do not guarantee that any generated or drafted document will be legally effective in your circumstances.
7. Communications and notices
By creating an account, you agree that we may send you service-related emails and messages, including account verification notices, password reset messages, payment confirmations, billing updates, security alerts, document notifications, and reminders related to your use of the service.
Where allowed by law, we may also send you product updates and service announcements. You remain responsible for monitoring the email address associated with your account and for ensuring it can receive messages from Echo Effect.
8. Intellectual property
Echo Effect and its related software, workflows, user interfaces, branding, graphics, copy, design elements, and proprietary content are owned by us or our licensors and are protected by intellectual property laws.
Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for your internal personal or household estate planning purposes. You may not copy, sell, sublicense, redistribute, or create derivative works from the platform except as allowed by law or with our prior written consent.
9. Disclaimer, availability, and warranties
The service is provided on an as available and as is basis to the fullest extent permitted by law. While we use reasonable efforts to maintain platform availability, secure records, and improve document workflows, we do not warrant that the service will be uninterrupted, error free, or suitable for every estate planning scenario.
We disclaim all implied warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee outcomes from using guided content, AI-assisted suggestions, or document templates. Professional review may still be required.
10. Limitation of liability
To the fullest extent permitted by law, Echo Effect and its officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or anticipated savings arising out of or related to your use of the service.
Our aggregate liability for claims arising out of or related to the service will not exceed the greater of the amount you paid to Echo Effect in the twelve months preceding the claim or one hundred Canadian dollars.
11. Suspension and termination
We may suspend, restrict, or terminate your access to the service if we reasonably believe you violated these terms, created security or compliance risks, failed to pay applicable fees, or used the service unlawfully or abusively.
You may stop using the service at any time. Certain provisions of these terms will survive termination, including provisions relating to intellectual property, disclaimers, limitation of liability, payment obligations, and dispute resolution.
12. Governing law and contact information
These terms are governed by the applicable federal laws of Canada and the applicable laws of the province or territory determined under ordinary conflict-of-law principles. Unless applicable law requires otherwise, disputes must be brought in a court of competent jurisdiction in Canada.
